Pirate Party: Proposed EU-US data protection “Umbrella agreement” breeds human rights violations

Pirate Party data protection expert Patrick Breyer dismisses the EU-US data protection “Umbrella agreement”[1] as “entirely insufficient and violating human rights”.[2] Breyer says:

This agreement will not prevent US authorities from abusing our data for extralegal drone killings, for infinite imprisonment without indictment or for adding to their no-fly or other ‘black lists’. No limits worth mentioning are to be imposed on the use and long-term retention of European data in the US, not even concerning particularly sensitive data such as pertaining to our sexual life. When US authorities violate the few limits that have been agreed on, there is no independent data protection authority Europeans can address and no court to hear complaints against an illegal use or retention of our data in the US. Extending the microscopic US data protection rights to Europeans is worthless.
In fact the US do not grant effective data and human rights protections even to their own citizens. The German Federal Constitutional Court (Bundesverfassungsgericht) has accepted my complaint of unconstitutionality against the international exchange of personal data and will hopefully deliver a landmark decision on the matter shortly: We need a general ban on the disclosure of personal data to states lacking effective human rights protections. I call upon the EU Parliament to reject the dirty EU-US deal and defend our fundamental rights!
